What we agree, in plain language.
These are our terms. They are short, because we do not want to agree anything you cannot read in one go. What is here is what applies.
1.What swungby does
swungby shows which companies visit your website, how certain that is, and what you could do about it. You get an account, a line for your site, and access to your overviews.
2.What it costs
While we are new, everything is free. If that is going to change, you hear it at least a month in advance by email, and you can stop without cost until that day. What you used until then costs nothing.
3.Cancelling
You cancel with one button in your account. That works immediately, without a notice period and without anyone from us having to approve it. A paid plan runs until the end of the month you have already paid for; then it stops.
4.Renewal
A paid plan runs per month and renews per month. There is no yearly contract and no automatic renewal for a longer period.
5.Price changes
If we raise a price, you hear it at least a month in advance, and you may cancel until the effective date. An increase is never more than three percent a year, unless you choose a different plan yourself.
6.Above your limit
If you go over the number of companies in your plan, we keep counting and hide nothing. We send you a message and suggest a bigger plan. You choose; we never move you automatically.
7.What you may expect from us
We do our best to keep swungby working at all times and fix outages as fast as we can. If it goes down, no visits are lost: we process them afterwards. We do not guarantee a recognition percentage, because that depends on who visits your site.
8.What we expect from you
You place the line only on websites that are yours or that you have permission for. You use what you see as the law allows: approaching a company is fine, following someone personally is not. And you put the paragraph about swungby in your privacy statement.
9.Data
What we record about your visitors, for how long, and where it is stored, is in our privacy text. It is part of these terms. If you cancel, we clean everything up according to the periods stated there.
10.Liability
If damage arises from a mistake of ours, we compensate at most what you paid us in the twelve months before. We do not compensate consequential damage, such as lost revenue. This does not apply if the damage results from our intent or gross negligence.
11.Changes to these terms
If we change something, you hear it a month in advance by email, with the old and new text side by side. If you disagree, you can cancel until that day.
12.Law and disputes
Dutch law applies to these terms. If we cannot work it out together, the court in the Netherlands decides.
